The European Health Data Space (EHDS)
As part of our project work in the Health-X ecosystem, we have been looking closely at the European Health Data Space and want to share some of the most important points here. Health-X can be seen as a technological enabler for the European Health Data Space, while the EHDS provides the regulatory and conceptual framework for exchanging health data across the EU.
On March 14, 2024, the EU member states, the European Parliament, and the European Commission reached an agreement on the regulation establishing the European Health Data Space. This was a major step that formalized many developments Germany had already started in 2023 through the Digital Act and the Health Data Use Act.
The Digital Act, adopted in December 2023, laid the foundation for the digitalization of healthcare in Germany. Among other things, it introduced the electronic patient record as an opt-out model, meaning that from 2025 every publicly insured person will automatically receive one unless they object. It also made the e-prescription a binding standard.
The Health Data Use Act, also passed in late 2023, regulates the use of health data for research purposes. It creates a legal framework for accessing and analyzing health data while maintaining strict data protection safeguards.
What Exactly Is the EHDS and What Benefits Does It Bring for Citizens and Healthcare Professionals?
The EHDS aims to establish clear rules, common standards, and practical mechanisms for the use of health data. Every second, enormous volumes of valuable health data are generated across the EU. Doctors, nurses, pharmacists, researchers, and public health authorities depend on this data for their critical work.
The COVID-19 pandemic made it especially clear how important up-to-date health data is for effective public health measures and crisis response. It also accelerated the adoption of digital tools. Even so, significant barriers still limit the full potential of digital health and health data use. The EHDS is intended to remove these obstacles by providing a robust governance framework for electronic health data and by strengthening the internal market for digital health services and products.

A simple example illustrates the benefit: a German citizen who becomes ill while on holiday in Spain could be treated immediately by a local doctor with access to the patient's full medical record, including translation support. Prescription information could also be used seamlessly in Spain or other EU countries.
